Nightclub owner gets 28 day suspended sentence for playing music without permission

Phonographic Performance Ltd v Fletcher, High Court

The High Court has ruled that a nightclub owner should receive a 28 day prison sentence for failing to have an appropriate licence and pay the relevant fees for music played at his nightclub. The sentence has been suspended for a year. The aggravating features were that there was a history of failing to obtain the licence. However, the Court was sympathetic in its decision in light of his ill health, family bereavement, separation from his partner and part time caring for a child. He was still ordered to pay significant costs, however.
